LEGISLATIVE NEWS March 29, 2008 On May 13th, the North Carolina Legislature will convene for the Short Session. During the Short Session, our lawmakers typically focus on budgetary concerns. We anticipate this short session will be no different. We believe they will focus on the budget, including the education funding formula, the failed mental health reform bill of 2001, transportaton and the drought. Our Genenral Assembly members will be reluctant to tackle controversial issues with the elections right around the corner. Additionally, these same lawmakers will be eager to get back to their districts to raise money and to campaign. All of this is to say, that while we will remain vigilant about bail legislation, the short session is not a time to introduce major changes. Important Revision to Motion to Set Aside Statute We have had many calls regarding the revision of 15-544.5 to add a seventh reason (incarcerated anywhere) to have a forfeiture set aside. Below you will find a link to the revisions to the Statute. Be sure that proper notice and documentation are given. The Administrative Office of the Court has revised the Motion to Set Aside form, AOC-CR-213, adding Reason #7. Please Click Here to read the changes to the statute. It has been put here in PDF format due to its length. PDF format requires the Acrobat Reader download below.
